TSR General Terms and Conditions


Your receipt of a resume, interviewing or engagement of a candidate in any capacity, or the passing to any other person or organisation of personal information pertaining to a candidate introduced to you by us, will be taken as your acceptance of our terms of business. No variation can be made to these terms without the written consent of a Partner of TSR Corporate Services (hereinafter called “TSR”).



You (the client) will be responsible for providing a safe and healthy workplace for all TSR personnel. TSR will work with you to provide assistance in achieving a safe working environment.



You are responsible to pay our hourly fee as agreed at the time of booking, for all hours worked by the temporary worker. You may be required to sign weekly time sheets that we rely upon as an authority to process payment to the temporary worker and confirmation of your satisfaction with our services. However, failure to sign the time sheets does not alter your liability to pay for hours worked. Please note that the minimum daily booking fee for a temporary worker is four (4) hours.


Overnight penalty rates in accordance with the Federal Award are applicable to bookings between 8pm and 7am, and will be included in your quoted cost at time of booking.


Cancellation fees: If a confirmed booking has been cancelled within twenty four (24) hours’ notice of the commencement time of the shift, the charge for four (4) hours’ minimum work will be applicable.



Whilst we make every effort to provide a temporary worker in accordance with booking details and to ensure reasonable standards of skills, integrity and reliability from the temporary worker, TSR accepts no liability (by reason of the human element) for any loss, expense, damage or delay arising from any failure to provide any particular temporary worker for all or part of the period of the booking, nor for any negligence dishonesty,

misconduct or lack of skills of the temporary worker provided and you agree to indemnify us and each of our employees and/or agents in respect of any claim, suit, demand and cause of action and from all damages, costs, expenses and penalties of every description whatsoever arising from or related to the employment of the temporary worker.



The Employer agrees that the introduction of applicants by TSR for temporary or casual contract assignments with the Employer shall constitute a referral and that if the applicant is employed by the Employer within 12 months of the referral to pay TSR the fee SET OUT IN

Condition 6, (hereinafter called “the prescribed fee”). If the applicant is employed, as specified in Condition 5 the Employer agrees:


a) to inform TSR of the fact in writing within seven days after commencement of such employment;


b) to pay TSR the prescribed fee within fourteen days after the commencement of such employment.



Applicants employed on gross annual salary package or wage basis equivalent to:

N.B. The above percentages apply to the annual salary package or wage equivalent for one year, irrespective of the period of employment. Gross annual salary package is the aggregate of salary, superannuation contributions, defined benefits, allowances and other emoluments.

A company vehicle is regarded as an income benefit and an arbitrary $10,000 will be added to determine income. Live-in benefit is also regarded as an income benefit and $10,000 will be added to determine income.

Notice- Any notice required to be given by the Employer may be affected by posting by prepaid post a copy of such notice addressed to TSR Corporate Services, 4/59 Cawkwell St, Malvern, VIC 3144.

Withdrawals- Should the assignment be withdrawn for any reason, TSR reserve's the right to charge a withdrawal fee of $500.00 plus any advertising costs incurred.

Guarantee- If the applicant is employed, as specified in Condition 5 hereof, and leaves such employment within the guarantee period set out below, TSR undertakes to provide a suitable replacement for the applicant without additional charge to the employer, provided always that no replacement shall be made:

a) Unless payment of the prescribed fee has been made within fourteen (14) days, as specified in Condition 6 hereof; and if payment has not been made the Employer shall be and remain, liable to pay the full fee.

b) Unless notice in writing that the applicant has left the employment is received by TSR within seven (7) days thereafter.

c) If the position description alters or the specific vacancy is withdrawn.

d) If the Applicant ceases to be so employed as a result of retrenchment.



The Employer agrees that all advertising undertaken by TSR on behalf of the Employer will be charged separately to the employer, except with written exception.



We do not conduct police checks on temporary or permanent workers unless directed to do so by you. However upon request to complete a police check you will incur the fee.

The engagement of a temporary, casual or contracted (on-hired) worker by the Client is deemed as acceptance of TSR Consultants Australia Pty Ltd’s (TSR's) Terms & Conditions. The Client agrees to pay the hourly charge, as advised by TSR at time of

booking, for all actual hours worked. Our minimum booking time is four (4) hours.

GST will be shown as an additional charge to you on our invoice. TSR's hourly charge rate includes payment of wages, superannuation, payroll tax and WorkCover. Hourly charges are subject to rises and falls that may impact from time to time.


The Client is invoiced weekly on seven (7) day payment terms. NB Should your account exceed our trading terms and be passed over for collection, all costs, interest, debt collection commission and any out of pocket expenses will be the liability of the client. Signed and Client approved timesheets will be deemed as acceptance of hours worked. No adjustments to hours worked will be considered so please check timesheets carefully. Late payment may attract collection costs to be borne by the Client, including interest on past due amounts.


The Client agrees to pay TSR's scheduled placement fee should an on-hired worker be engaged to perform any task, or is engaged by any organisation that provides services to the Client, or is engaged by a related entity, within six (6) months of the completion of

their last assignment for the Client through TSR. The Client acknowledges that we are not performing the services required of our employees or independent contractors; but are instead the supplier of our employees and independent contractors, at the Client’s request, to perform work that it has requested. From the time our employees and independent contractors report to the Client for their duties they are under the care, control and supervision of the client for the duration of the assignment. In these circumstances, the Client agrees we will not be liable to the Client in respect of any damage, loss or injury of whatsoever nature or kind, however caused, whether by our negligence or the negligence of one of our workers, their servants or agents or otherwise, which may be suffered or incurred, whether directly or indirectly, in respect of the services provided under these conditions of the agreement.


The Client agrees to provide TSR with a job description for each assignment and to induct the worker to the workplace and instruct the worker in the job to which they are assigned. The Client agrees not to allocate tasks or responsibilities to TSR's workers outside of the agreed job description. The Client agrees to allow TSR to conduct a site visit for hazard identification prior to, or whilst, a TSR worker is on a Client site. TSR conducts a general induction for workers that is NOT job specific, but assists workers to gain a basic understanding of OH&S procedures. The Client agrees to provide and maintain plant and

systems of work for TSR 's workers that are so far as practicable, safe and without risks to their health. The Client will also provide such information, instruction, training and supervision to TSR's workers in the Client’s control as is necessary to enable them to

perform their work in a manner that is safe and without risks to their health.

The Client agrees to inform TSR of any injury sustained by a TSR worker as soon as is

practicable and to provide copies of injury reports and accident investigations and to allow TSR's employees to conduct post-injury risk assessments in order to meet legislative requirements and for injury prevention purposes. For compliance and rehabilitation

purposes, documentation must be forwarded to TSR within 24 hours of any incident or accident.

We, at TSR, acknowledge the need to achieve high quality standards and the provision of excellent Client service. We will make every effort to ensure Client satisfaction by providing quality, skilled and reliable temporary and casual on-hired workers in accordance

with booking details.

While information is the cornerstone of TSR Corporate Services’ (thereafter TSR) ability to provide superior service, our most important asset is ensuring your trust. At TSR we are strongly committed to protecting your privacy. We understand and appreciate the fact that you are concerned about the privacy afforded to your information collected via any means. We are committed to providing a high level of privacy in relation to all personal information that is collected. The following statement explains how we manage your personal information in accordance with the privacy laws.


The type of information collected

Personal information is any information or an opinion (whether true or not) about you. It may range from the very sensitive (e.g. medical history or condition) to the everyday (e.g. address and phone number). It would include your work experience and qualifications, aptitude test results and other information obtained by TSR in connection with your possible work placements. Sensitive information can, in most cases, only be disclosed with your consent. The type of personal information that we collect and hold generally falls within the following areas:

·candidate submitted and obtained information including other sources in connection with applications for work;

·work performance information;

·incidents within the workplace;

·information submitted and obtained in relation to absences from work;

·information obtained to assist in managing client and business relationships.

If you choose not to provide personal information, we may not be able to provide you with the services you require, or the level of service on which we pride ourselves.


How your information is collected

Where practicable we collect your personal information directly by you as included in your application or resume, when you fill out and submit one of our registration forms, when you deal with us by the telephone, letter, fax, email or visit our website.

Personal and sensitive information will also be collected when we receive any reference about you or we receive results of inquiries that we might make of your former employers, work colleagues, professional associations or registration body or we receive the results of any competency or medical test or we receive performance feedback (whether positive or negative) or we receive any complaint from or about you in the workplace or we receive any

information about a workplace accident in which you are involved or we receive any information about any insurance investigation, litigation, registration or professional disciplinary matter, criminal matter, inquest or inquiry in which you are involved or you provide us with any additional information about you and any other situations as they may arise. If we don’t have your prior consent we will take reasonable steps to inform you that

we have collected personal information. TSR will collect your personal and sensitive information for its own use in connection with your work placements.


How we may use and disclose your personal information

We may use and disclose your personal and sensitive information for the primary purpose it was collected or for a related secondary purpose such as providing you with one of our services. Your information may be used in connection with:

· recruitment - assisting you in finding work or retaining work;

· our assessment of your ongoing performance, our identification of your training needs, employment prospects and referees;

· any test or assessment (including medical) you might be required to undergo;

· our management of any complaint, investigation or inquiry in which you are involved; any workplace rehabilitation;

· our insurers; a Workers Compensation body; any insurance claim or proposal that requires disclosure of your personal or sensitive information;

· potential and actual employers and clients of TSR including all client and business relationship management;

· marketing services, research and development;

· a professional association or registration body that has a proper interest in the disclosure of your personal and sensitive information our contractors and suppliers of services to TSR and other members of the TSR Personnel Group;

· any person with a lawful entitlement to obtain the information.


gaining access to the information we hold about you

Subject to some exceptions set out in the NPP’ s, you may request to access the personal or sensitive information that TSR holds about you. We do refuse access if it would interfere with the privacy rights of other persons or it breaches any confidentiality that is attached to that information.

If you wish to contact TSR or gain access to your information you should contact TSR’s Privacy Co-ordinator (a Partner of the business).

You will need to be in a position to verify your identity before any information may be released to you.

In some cases we may impose a moderate charge for providing access to your information. You should also anticipate that it may take a little time to process your request for access (allow approximately 6 weeks) as there may be a need to retrieve information from storage and review information in order to determine what information may be provided.


keeping your personal information up to date

If your personal information changes please contact TSR and we will take reasonable steps to update and correct the information. If we are unable to agree that personal or sensitive information that we hold about you is accurate, complete and up-to-date, you may ask TSR to place with the information a statement by you that claims that particular information is not accurate, complete and up-to-date.


if you do not give us the information we seek

If you do not provide TSR with the information we seek, we may be limited in our ability to locate suitable work for you or we may be limited in our ability to place you in work.


security of your personal and sensitive information

We will always maintain control over the confidentiality of your information. Proper security against misuse, loss and unauthorised access, modification or disclosure of personal information will be provided. All personal and sensitive information may be stored either in hardcopy or electronically. TSR has security procedures in place to protect your information.


additional materials

TSR may send you copies of our newsletters and additional related marketing material. Should you not wish to receive this information you may request to be removed from the distribution list. Any information provided to TSR remains the property of TSR. This information may be used for marketing purposes, or to contact you for further feedback on the services provided by TSR.


No information provided to us subject to the above policy, except where outlined above, will ever be sold, shared or provided to any third parties under any circumstances.
